What is the Form 5500? Do I need to submit it?

Form 5500 is the Annual Return/Report of Employee Benefit Plan required by the IRS and the Department of Labor of employers that offer a health or welfare benefit covered by the Employment Retirement Income Security Act of 1978 (ERISA). Only employers with more than 100 employees are required to file it.

Venteur will let you know you if you need to submit a Form 5500 and send you a reminder alert 3-months before your filing deadline. We will assist you in preparing your report and provide you with instructions on how to submit your report via the Department of Labor's EFAST2 filing system.

Form 5500s are due on the 7th month after the end of the plan year. For example, if your plan year ends on December 31st, then your Form 5500 is due in July.

Please note that if you do not submit a Form 5500 and are required to do so, you may face penalties and fines from the Department of Labor.
